The Federal Court of Brazil has rejected Spribe’s Motion for Clarification, meaning the preliminary injunction at the centre of the ongoing dispute with Aviator Studio remains in place.

Aviator Studio responded to the motion on August 14. In its latest decision, the Court confirmed that the injunction continues to have effect and made clear that any challenge to the merits of the original ruling must be brought through the correct legal procedure.

Judge Arthur Pinheiro Chaves said that an appellant seeking to challenge the substance of the decision must use the appropriate procedural mechanism.

The ruling means Spribe’s Motion for Clarification has not changed the original decision or the existing effects of the preliminary injunction.

Spribe can still seek further review of the decision before the Federal Court of Appeals by filing an Interlocutory Appeal.

The decision represents another significant stage in the proceedings for Aviator Studio, which continues to pursue the case through the Brazilian courts.

The company said it remains focused on protecting its intellectual property rights and the integrity of its Aviator brand.
